Law in India

Law of Tort

Anything that doesn’t belong to Civil law or Common law comes under Tort. Tort is unwritten law and popularly known as judge made laws. Under Tort, one can seek remedy for damages provided somewhere a legal wrong is committed through action or omission.

For example, it is the job of the nurse to give care to the patient. If the nurse leaves the patient with oxygen mask but does not come back to check the supply and the patient dies due to lack of oxygen causing patient to die.

For example, it is the job of the nurse to give care to the patient. If the nurse leaves the patient with oxygen mask but does not come back to check the supply and the patient dies due to lack of oxygen causing patient to die.

This act is an act of negligence because it is the job of the nurse to take care of the patient.

But if there was no supply of oxygen even after the nurse has informed, the blame falls on the owner of the hospital. So, the patient’s family can go to the court on the grounds of negligence of duty “responsibility for care.”
